The appeal in each case is from an order of the District Court dismissing the complaint which attempted to allege a stockholders derivative action for libel. The plaintiff in each case is George Schmidt, a resident of Illinois. He filed suits on behalf of the Tucker Corporation, organized under the laws of Delaware, against The Crowell-Collier Publishing Company, a Delaware corporation; The Readers Digest Association, Inc., a New York corporation; and Esquire, Inc., a Delaware corporation.
